I am not a lawyer, but my opinion is THJMW made a ruling on the Global settlement . She ruled it is accepted by her. On the POR she ruled it is not accepted. She rules on the trust preferred that the exchange did take place. Unless EC makes a motion to reconsider like I did or makes a formal appeal we are out of luck. All Rosen has to do is settle the releases with EC if he wants to. But as for the global settlement it is a done deal. Finished, the judge can if this is not appealed give us the 4 billion take the tax credits and cancel all the lawsuits. The 4 billion she said it may belong to us but did not rule on it. Therefore it will go under the global settlement. we get 4 billion nothing for unjust enrichment or interest etc. WMI our company agreed to this settlement and the judge went with them,. The judge is against us. She is for the US government who told her to accept the global settlement, but she left a few doors open for us to get some money by changing the POR to make the wahmq into preferred and puting the releases on the market. Maybe Susman will settle cheap or he has to appeal the global settlement to a higher court.
