Podrías explicar en que basas tus expectativas.

Tienes alguna información privilegiada; algún dato para tomar en cuenta.

Te digo esto porque muchos inversores, estamos conscientes de que en este momento dependemos netamente de:

1) Labor del examiner
2) Labor de Susman
3) decisión de la Juez

La Fdic no va a cooperar con el examinador, y sólo va a hacer una entrega voluntaria y limitada de documentos de discovery, escudándose como al principio en FIRREA. JPM tampoco está dispuesto a cooperar y sólo va a entregar ciertos documentos. El resto de partes EC, TPS, acredores, están dispuestos a total cooperación y entrega de documentos solicitados por el examiner.

Esto se pone interesante, si todo fue legal, porque tratan de ocultar todo hasta a el Examiner??? Esta gente tienen que tener més merda debajo de la alfombra...

3 JPM / FDIC / TPS (08/02/10!)

A ver si la juez no está corrupta, y permite a este examinador hacer todo lo que el crea necesario que tiene bastante buena pinta su plan de trabajo.

From mr.hochberg:

1. the examiner and the debtors have begun discussions to schedule interviews of debtor employees and agents during the week of august 16.

2. the examiner has reserved all rights with respect to this issue and is currently reviewing the memorandum which the fdic subsequently provided on august 4.

3. jpmc also agreed to make employees and agents of jpmc available for interview by the examiner. The examiner has begun the process of indentifying additional information and document to be requested from jpmc and to identtify possible witnesses.

4. an analysis will be conducted to determine the effect of potential recoveries, specifically wether they would likely impact equity or other out of the money claimants potential recovery.

5. the examiner will identify and evaluate the competing claims to tax refunds totaling 6 billions, the division of which is a critical part of the settlement component.

6. issues related to the fdic: …the duties and obligations of the fdic are a critical part of the settlement component. The examiner intends to conduct both a legal and factual investigation of this issues

7. avoidance actions: ,the examiner intends to investigate these conveyances to determine whether they are avoidable and, if so, from whom they are recoverable and the consequences of avoiding such transfers to the debtors bancrupcy estates.

8. the examiner will focus his investigation on claims against parties involved in the sale and marketing of the debtor prior to seeking bancruptcy protection, the failure and seizure of washington mutual bank and conduct which has taken place since the petition date.

9. the examiner requests that he be authorized, without firther order of the court, to demand and compel by way of subpoena, the production of documents that may be relevant to the investigation or sworn testimony of witnesses with knowledge of facts relevant to the examination.
