http://www.kccllc.net/documents/0812229/0812229100423000000000005.pdf

"I would think the court may entertain the appointment of an indepedent court appointed examiner to do the necessary financials....and hopefully Susman will file this by May 3rd along with their Objection to Blackstone and should be heard at the May 5th hearing...

http://www.wamuequityrights.org/index.php?option=com_content&view=article&id=12&Itemid=7

"April 22, 2010: We are expecting to see a shareholders' action filed in Washington State court today, based on a Seattle Times news report (see link in 4/21, below). The Equity Committee's lawyer, Stephen Susman, "said the shareholders would go to court in Washington on Thursday asking a judge there to order the convening of an annual meeting. "It's our hope that we can get this done as soon as possible," said equity committee Chairman Michael Willingham, who testified he bought more than a million shares of WMI last year after its bankruptcy filing." In addition, in court yesterday Susman said that the Equity Committee would be filing a motion in Bankruptcy Court by early next week for the appointment of an examiner. According to bankruptcy law, 1104(c), an examiner is appointed "to conduct such an investigation of the debtor as is appropriate, including an investigation of any allegations of fraud, dishonesty, incompetence, misconduct, mismanagement, or irregularity in the management of the affairs of the debtor of or by current or former management of the debtor". We will provide updates here as news becomes available."
