Rosebud must be so scared to start such desperate attempts, which are doomed from beginning.
Does he really think all other are idiots ? I think he has no other choice, so he choosed to present this BS to the court.
Such moves by him gives me more confidence than a rising pps.

Son opiniones al igual que la tuya.

1) To keep the FDIC as a signer to the GSA and not bail out. (Eg, have WMI pay for the WMB'ers, and not the FDIC)

2) To keep the argument alive against the Shareholders Meeting / Vote (assuming the Examiner's report shows more money, it keeps the shareholders at zero and is a counter to the Shareholders Meeting -- eg, the claim by Rosen that why have a shareholders meeting for an out-of-the-money constituency) *

3) To counter the upcoming Examiner's report, to ensure A

With this motion WMI is not asking the judge to rule that WMB bondholders in fact have a legal right to recovery against the estate, but only to rule that as a matter of law any right to recovery they may have is subordinate to all other creditors, and only stands in front of equity. The WMB bondholders have made noises previously that they are like secured creditors and should be in front of unsecured, and therefore should be paid in full.

IMO, by seeking to settle this one issue of priority (only), and by increasing the proposed payout to WMB bonds in the latest DS, WMI is trying to pressure the WMB bondholders to go along with WMI's GSA and POR, take their bribe, and go home. That way they avoid litigating whether WMB bondholders have any right to recovery from the estate at all, and if they can thereby make reliable allies out of the WMB bondholders, then they have one less stakeholder group to fight, and they can focus on eliminating equity by a similar divide and concur tactic. So, this is a part of the evil larger game plan to preserve all estate assets for FDIC, JPM and creditors and thereby effectively cut out equity entirely.

I'm sure the EC will weigh in on this one as it gives them another opportunity to call a spade a spade.
